U.S. Supreme Court to Hear Arguments on Constitutionality of Health Care Reform

The U.S. Supreme Court has announced that it will hear more than five hours of oral arguments on the constitutionality of select provisions of the health care reform law (Affordable Care Act or PPACA). The arguments are expected to take place in late February or early March, with a ruling by the Court in June.

Medicare Part D Creditable Coverage Disclosure Notices Must Be Distributed Prior to October 15

The U.S. Department of Health and Human Services (HHS) has issued proposed rules outlining the basic standards employers must meet to voluntarily participate in a SHOP (Small Business Health Options Program). The Affordable Care Act directs each state that operates an Affordable Insurance Exchange, a state-based competitive marketplace where individuals and small businesses will be able to purchase private health insurance beginning in 2014, to provide for the establishment of a SHOP to assist qualified employers and facilitate the enrollment of certain employees into qualified health plans.

Proposed Rules Regarding Summary of Benefits and Coverage Required Under the Affordable Care Act

The U.S. Departments of Labor, Health and Human Services, and the Treasury have proposed new rules that establish standards for group health plans to provide, without charge, a summary of benefits and coverage (SBC), as well as a uniform glossary of terms commonly used in health insurance coverage, as required under the Affordable Care Act. The Departments also issued a proposed template for the SBC (with proposed instructions and sample language for completing the template) and a proposed uniform glossary. The new requirements would be applicable beginning March 23, 2012.

New Guidelines Expand Required Coverage of Preventive Services for Women Under the Affordable Care Act

On August 1, 2011, the U.S. Department of Health and Human Services (HHS) adopted additional Guidelines for Women's Preventive Services requiring new health insurance plans to cover women's preventive services such as well-woman visits, breastfeeding support, domestic violence screening, and contraception without charging a co-payment, co-insurance or a deductible starting in August 2012. The guidelines were recommended by the independent Institute of Medicine (IOM).
